This article considers Edward W. Said’s proposals on ‘imaginative geographies’ as suggested in his leading work Orientalism as a tool to analyse the ideological circumstances that shape geographical spaces in the Bible. My purpose is to discuss how these imaginative geographies are present in the patriarchal narratives of Genesis and how they have left their mark on the history of the interpretation of these texts and on the not always easy relations between members of the religious traditions inherited from the (...) Bible (Hebrews, Muslims and Christians). I propose four types of ‘imaginative geographies’: (1) ‘Equalness’ is the way to represent what is considered as sharing the own identity. The geography of ‘Equalness’ defines the spaces of Isaac, Jacob and their families. (2) ‘Otherness’ is the way to represent the ‘Other’ as opposite or juxtaposed to one’s own identity. A common border is shared, thus kinship relationships can be established. It defines the spaces of Ishmael, Esau/Edom, Lot (Ammon and Moab) and Laban. (3) ‘Foreignness’ is the way to define what is strange, odd or exotic considered as external to the own identity, in a space set beyond even the space of the ‘Other’. Egypt is in Genesis a land of ‘Foreignness’. (4) ‘Delendness’ encompasses whatever claims our same space and therefore threatens our survival and must be destroyed ( delendum ). As such, processes of annihilation and dominion of Israel on Canaanites and Sichemites are justified. Contribution: The article applies Said’s ‘imaginative geographies’ as an identity mechanism for the creation of biblical literary spaces. A quadripartite classification (‘Equal’/‘Other’/‘Foreigner’/‘Delendum’) instead of the usual bipartite one (‘Equal’ vs. ‘Other’) is proposed and the consequences for the current coexistence between religious identities inherited from Abraham are shown. The poetry of Blas de Otero (1961) andYehudaAmichai (1924-2000) invites the 20th century human being to speak out on the main issues of his existence: love, loneliness, suffering, solidarity, injustice, death, hope. A central place in their work is taken up by the merciful and faithful God of the Bible, whose image seems to be refuted by the dramatic situation in which the human being happens to live. The poet’s word stands up against God’s word equipped with his resources: intertextuality, (...) metaphor, comparison, antithesis, sound effects, irony. Behavioral interventions have shown promising neuroprotective effects, but the cascade of molecular, brain and behavioral changes involved in these benefits remains poorly understood. Projecte Moviment is a 12-week multi-domain, single-blind, proof-of-concept randomized controlled trial examining the cognitive effect and underlying mechanisms of an aerobic exercise, computerized cognitive training and a combined groups compared to a waitlist control group. Adherence was > 80% for 82/109 participants recruited. In this study we report intervention-related changes in plasma biomarkers and structural-MRI and how they (...) related to changes in physical activity and individual variables and their potential role as mediators in the cognitive changes. Our results show that although there were no significant changes in molecular biomarker concentrations in any intervention group, changes in ICAM-1 and SDF1-α were negatively associated with changes in physical activity outcomes in AE and COMB groups. Brain volume changes were found in the CCT showing a significant increase in precuneus volume. Sex moderated the brain volume change in the AE and COMB groups, suggesting that men may benefit more than women. Changes in molecular biomarkers and brain volumes did not significantly mediate the cognitive-related benefits found previously for any group. This study shows crucial initial molecular and brain volume changes related to lifestyle interventions at early stages and highlights the value of examining activity parameters, individual difference characteristics and using a multi-level analysis approach to address these questions. En varios pasajes de la obra de Lévinas vemos que su manera de presentarse frente a lo político es ambigua. O bien, resulta mejor decir que solo en apariencia el "objeto" de lo político en sus reflexiones sobre la justicia y el Estado resultan claras; hay una suerte de equívoco que vale la pena precisar y distinguir. Así, el objetivo central de este trabajo es describir dos momentos políticos en Lévinas leídos en clave Estado, como una figura posible de la (...) política; desentrañamos así la trama anti-política en tanto crítica política al Estado, para llegar a la trama del Estado justo e igualitario, lo que abre nuevas puertas para pensar lo político. A partir de esta descripción reflexionamos, por un lado, una postura crítica frente a las ideas sobre el Estado de Lévinas desde las vinculaciones ético-políticas que hace, tal como la de Alberto Sucasas. Y por otro, en contraposición a éstas, las interesantes y extravagantes lecturas que hace Miguel Abensour de Lévinas creyendo que las relaciones ético-políticas levinasianas aportan a renovar críticamente una nueva figura de Estado dejando el terreno político y estatal abierto a nuevas reflexiones. In several passages of Levinas' work we see that his way of presenting the political front is ambiguous. Or, more precisely, that the "object" of the political in his reflections about justice and the State is only apparently clear; there is a sort of equivocalness that is worth clarifying and distinguishing. The aim of this article is to describe two political moments in Levinas, read in terms of the State as a possible figure in politics. We thus unravel an anti-political theme which is critical of the politics of the State, in order to reach a theme of a State that is just and egalitarian. This opens up new territory from which to think of the political. One critique of Levinas' ideas of the State in terms of its ethical-political linkages is that put forth by Alberto Sucasas. A second contrasting critique is the interesting and extravagant reading of Miguel Abensour, in which Levinasian ethical-political relationships lead to a critical renewal of a new figure of the State, leaving the political and state terrain open to new reflections. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. Esa es la hipótesis que plantea el presente ensayo: ¿qué ocurriría si en lugar de la agotada certeza del yo, el mundo moderno se hubiera asentado más bien sobre la confusión y sobre la trampa que se condensan en la metáfora del genio maligno? This book develops a novel theory of intentionality. It argues that intentionality is an internal essential relation of constitution between an intentional state and an object or between such a state and a possible state of affairs as subsisting. The author's main claim is that intentionality is a fundamentally modal property, hence a non (scientifically) natural property in that it does not supervene, either locally or globally, on its nonmodal physical basis. This is the property, primarily for an intentional mental (...) state, to be constituted by the entities it is about. In the case of intentionality of reference, such constituents are objects, in the sense of individuals; in the case of intentionality of content, such constituents are possible states of affairs as subsisting. Constitution is meant in a mereologically literal sense: those constituents are essential parts of the relevant states. As a result, the theory claims not only that intentionality is relational, but also that is an internal, essential relation holding between an intentional state and its object or proposition-like content. Intentionality as Constitution will be of interest to scholars and advanced students working in philosophy of mind, philosophy of language, metaphysics, and cognitive science. (shrink)

Much has been written since the Covid-19 pandemic hit the world. The way in which we refer to this and other diseases has been commented and criticized in the media and in public online forums. Several linguists have referred to the different metaphors with which we refer to the disease appealing to our social responsibility towards the words we use to refer to sensitive subjects and have compiled alternative forms to “the war metaphor”. There is a linguistic, political, and even (...) health concern about the possible consequences of referring to Covid-19 as a war. However, the conceptual metaphor DISEASE IS WAR is ubiquitous, the key is: it is conceptual, it is a metaphor of the mind and not of language. Moreover, its variations and changes are a reflection of human creativity, but there is nothing wrong with the metaphor per se. In any case, it is a means to criticize certain discourses and there, as in everything, the context of the communicative act is ineludible. In this article we will see some examples of how we refer to SARS-CoV-2 in different media and explain the ubiquity of the metaphor. We shall also note that there is nothing wrong with the metaphor itself, which is, in fact, based on a biologically hooked form, present in human cognition, to refer to something that threatens us and that we must avoid or combat. In this paper I want to hold that contextualism – the position according to which wide context, i.e., the concrete situation of discourse, may well have the semantic role of assigning truth-conditions to sentences – may well accommodate (along with some nowadays established theses about the semantics of proper names) three data about fiction, namely, the facts that as far as discourse involving fiction is concerned, i) sentences about nothing are meaningful ii) they may be true in fiction iii) yet (...) they may also be true in reality. Moreover, I also want to hold that such a contextualist accommodation does not depend on endorsing a realist stance about fictional entities, although such a stance gives the best truth-conditional explanation for such data, in particular iii). En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. The objective of this study has been to establish the level of significance that Gustavo Gutierrez and Juan Luis Segundo attribute to politics in their contributions to liberation theology and to extract the relevant consequences for political theory. ;A systematic analysis of the theory of history in the works of these two authors indicates a higher level of integration between Christianity and politics that is usual in Christian political thought. Liberation is equated with salvation and political liberation is seen as (...) one of its components. This brings politics to a position of privilege. When at the service of justice it occupies, for our authors, a high rank among Christian concerns and when devoted to oppression it requires diligent response from every Christian. ;This understanding of politics is valuable in that it accentuates the political aspect of the Christian theory of history, an element frequently underestimated. Certain tensions remain, however, in the theory as a result of this emphasis: between the moral improvement expected from the involvement in political activities conducive to justice and the moral ambiguity of political structures emerging from such activity; and between the use of the concept of class struggle and notions of conversion and reconciliation. Finally, there is the danger of reducing the critical ability of Christians regarding a particular political project by identifying it with the concept of eschatology. (shrink)

BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)

Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

El artículo examina algunos de los límites del derecho antidiscriminatorio en su actual configuración, a partir de las grandes tendencias que le dan soporte desde el punto de vista legislativo y jurisprudencial. El texto plantea una reflexión sobre los principios interpretativos tradicionales y los problemas de incorporación en el juicio de igualdad de estándares de orden explicativo y justificatorio que permitan captar los patrones o estructuras sociales de discriminación e identificar de forma más precisa a los sujetos. A tal efecto (...) propone la ampliación del espectro argumental de la discriminación indirecta y la igualdad material, a través de criterios interpretativos adicionales derivados de categorías como la discriminación estructural y la interseccionalidad de las discriminaciones. La filosofía, como "toma de posición razonada respecto a la totalidad de lo real", constituye todavía hoy, en la modernidad tardía, quizás no un saber propiamente dicho, pero sí, en todo caso, una "sabiduría buscada" ; una sabiduría que se constituye por relación a la razón y que no renuncia a abordar las cuestiones últimas, fundamentales y metafísicas. El filósofo resulta, pues, guardián de una tradición de inquietudes y problemas intelectuales hondamente humanos que no deben ser acallados. Para ellos la (...) ciencia no tiene una adecuada solución, pero permanecen ahí incitando al pensamiento e invitando a superar toda concepción positivista de la razón. ¿Cómo hacer compatible la pervivencia actuante de esa tradición y el irrenunciable criticismo que hacia la misma mantiene, por razones sobradamente justificadas, la racionalidad ilustrada? He aquí quizá una de las tareas más difíciles, pero también más estimulantes, que tiene ante sí la filosofía actual. (shrink)
